This Indenture , made this Twenty ninth day of January in the year of our
Lord, one Thousand eight hundred and thirteen Between John Graham
of the County of Henrico and State of Virginia by Walter Dun his agent & attorney
in fact , of the one part , and Richard Foster of the County of Ross and State of169
Ohio , of the other part . Whereas the said John Graham by letter of Attorney
under his hand and Seal duly executed , dated the Eleventh day of August
1808 did authorize the said Walter Dun in the name of him the said
John Graham to sell , and convey in fee simple , all his lands in the
State of Ohio , as will appear by the records of the County of Ross where
the said letter of attorney was recorded , on the fifth day of September in
the year of our Lord one thousand eight hundred and eight , Now This
Indenture Witnesseth , that the said John Graham by his
attorney aforesaid , for and in Consideration of the sum of Two hundred & Seventy
Six Dollars to him in hand paid , the receipt whereof he doth hereby acknowl
edge, and forever acquit and discharge the said Richard Foster his heirs Executors
and administrators , hath granted , bargained , sold , released and confirmed
and by these presents doth grant Bargain sell release and Confirm unto
the said Richard Foster his heirs and assigns forever , all that tract or
parcel of Land lying & being in the County of Ross and State of Ohio
on Crooked Creek , and bounded and described as follows to wit , Begin
=ning at an ash , white Oak ( both down ) and pin oak , southeasterly corner
to the Original survey thence No 23 degrees W 210 poles to two beeches , thence S 70 degrees W 76
poles crossing the Creek to an elm and beach thence No 68 degrees W 3 6 poles to a
beach and sugar tree ; thence S 20 degrees E 233 poles , crossing the Creek three times
to a black oak , white oak , and hickory ; thence No 68 degrees E 114 poles to the Beginning
Containing one hundred and Thirty eight acres of land ( being part of the said
Grahams survey No2908 and 4705) , be the same more or less according to
the Boundaries aforesaid : which said Tract of land was entered and surveyed
for the said John Graham on parts of Military Warrents No 4706 and No
2938 as will appear by the books of the principal surveyor for the Virginia
Military lands of the Continental line . Together with all improvements
and appurtenances whatsoever , to the said premises belonging or in any wise
appertaining , and all the Estate , right , title , interest , claim & Demand
of him the said John Graham of , in , and to the same , To have and
To hold the land hereby conveyed , with all the premises , and every
part and parcel thereof , with every of the appurtenances , unto the said
Richard Foster his heirs and assigns forever . And the said John
Graham by his attorney aforesaid for himself and his heirs , all the premises
hereby bargained and sold with the appurtenances , to the said Richard Foster
and his heirs and assigns , against him the said John Graham and his heirs
and all and every other person or persons whomsoever , doth , and will warrant
and forever defend by these presents . In Testimony whereof the said John
Graham by his attorney aforesaid , hath hereunto set his hand and seal the
Day and year first in this Indenture written .

in and for the County aforesaid , the within named Walter Dun who
as attorney in fact of the within named John Graham acknowledged
the within signing and sealing to be his act and Deed for the purposes
therein mentioned , Given under my hand and seal at Chillicothe
this 29th day of January 1813 .
